What design and construction insurance is?

Design and construction insurance is commonly used to describe professional indemnity insurance arranged for contractors and other construction businesses that provide, coordinate or assume responsibility for design or other professional services.

A contractor can have design liability even when the technical design is completed by a consultant. The head contract, consultant appointments, project delivery model and actual scope of services can allocate or create responsibility for design coordination, specifications, performance requirements, certification, advice or project management.

How design liability can arise?

Design and professional responsibility may arise through:

  • in-house design, engineering, drafting or specification work
  • design work performed by subcontracted or novated consultants
  • design coordination or integration across multiple disciplines
  • delegated design, shop drawings or technical submissions
  • performance-based specifications or value engineering proposals
  • certification, inspection, project management or construction management services
  • tender-stage design input, warranties or contractual design obligations.

What a policy may cover

Cover varies between insurers and policies. Depending on the wording and underwriting outcome, a policy may cover selected civil liabilities arising from insured professional services, including:

Defence, investigation and expert costs incurred with the insurer’s consent

Damages or settlements the insured is legally liable to pay for a covered claim

The insured contractor’s liability arising from design work performed by appointed consultants, subject to the wording and rights of recovery

Specified additional benefits or extensions, which may include inquiry costs, mitigation costs, public relations costs, novated contracts or principals indemnity.

What the policy does not replace

Design and construct professional indemnity does not replace the policies needed for physical construction, operational and statutory risks. A construction insurance program may also need to consider:

Contract works

Main Purpose:

Selected physical loss or damage to insured works, materials and project property.

 

Important distinction:

Does not generally replace professional indemnity for design liability.

Public and product liability

Main Purpose:

Selected legal liabilities for third-party personal injury or property damage arising from business activities or products.

 

Important distinction:

The boundary with professional services depends on each policy. Professional services exclusions or write-backs may apply.

Workers compensation

Main Purpose:

Statutory arrangements for work-related employee injury or illness.

 

Important distinction:

Requirements differ by state and territory and are separate from professional indemnity.

Cyber insurance

Main Purpose:

Selected cyber incidents, data breaches, privacy liability and response costs.

 

Important distinction:

Professional indemnity may exclude or materially restrict cyber-related claims.

Management liability

Main Purpose:

Selected liabilities affecting directors, officers and the management of the business.

 

Important distinction:

It addresses different risks and is not a substitute for professional indemnity.
