Our Expert Advice

What is media liability insurance?

Media liability insurance is a form of specialised liability insurance for certain risks connected with creating, commissioning, editing, publishing, broadcasting, advertising, licensing or distributing content.

It is different to traditional Professional Indemnity insurance in that it is tailored for claims arising from media activities and the nuances to media businesses.

IMPORTANT  The examples on this page describe media exposures, not guaranteed cover. Not every exposure, claim, cost or activity is covered by every policy. Cover depends on the insuring clauses, definitions, exclusions, limits, sub-limits, excesses, conditions, territorial and jurisdictional provisions, retroactive date, endorsements and the facts of the claim.

Business activities that may create media exposures

Media exposures can arise where a business publishes or distributes material created by employees, contractors, clients, users or third parties.

Examples of allegations a business may need to consider include:

    1. defamation or other publication-related allegations;
    2. infringement of copyright, trade marks or other intellectual property rights;
    3. breach of privacy, confidentiality or misuse of information;
    4. misleading or deceptive content, advertising or promotional material; and
    5. liability connected with editing, licensing, syndication, user-generated content or content supplied by contractors.

These are exposure examples only. Whether insurance is available, and how a policy may respond, depends on the insurer’s terms, underwriting and the circumstances.

Who may consider this insurance?

Media liability insurance may be relevant to businesses and organisations whose business activities involve content, including:

01

Publishers, news and media organisations

02

Broadcasters, podcasters and production businesses

03

Advertising, marketing, design and communications businesses

The KBI Insurance team have demonstrated exceptional customer service, attention to detail, and reliable advice in addressing the specific and varied insurance needs of our Association.

They conducted a thorough review of our existing packages, offered valuable feedback, and ensured that we obtained optimal coverage at a reasonable premium.  As a result, we had no hesitation in partnering with them, and I would highly recommend their service to any other Association or NFP.
